Shouldn’t the punishment fit the crime?

Copyright plaintiffs often play hardball with minor infringers.  Gordon argues that in such cases, the remedy ought to be more limited.  Particularly, if the plaintiff hasn’t first availed itself of the DMCA takedown process.  Statutory damages shouldn’t be available in such cases.  This would deter abusive demand letters, and extortion-like negotiation tactics,  such as those employed by attorneys representing Getty Images, and others.
